Custom Website Development Agreement

To include:

Competitor site analysis and strategic positioning consultation
Keyword analysis and coding for search engine optimization (SEO)
Original layout design
A maximum of five (5) web pages
Copywriting and development of PDF files, forms, e-mail, navigation, site map etc.
Up to 5 professional stock photos
Domain and hosting fees for one year
Set-up of five e-mail accounts
If client currently has a domain, price will be adjusted accordingly ($35)

Additional Fee Information:

Website Maintenance

Maintenance includes any work required on the website or e-mail after the site is live and working. Estimates for large function changes can be provided upon request.

Requested changes or e-mail troubleshooting/administration on the site after the site is live will be billed at $95 per hour in 15 minute increments. Approval for all work will be obtained from client and charged to client's credit card.

The following services are not included and will require additional charges:

Database development or custom programming
Stock photos or graphics not available from iStock that are requested by the client
Changes required to the website to make it compatible with future releases of internet browsing software, operating software, or changes in technology (this includes mobile technology)
Internet marketing services (PPC, static ads, etc.)
A 15% management fee will apply to third-party charges after the initial design
Customized proposals will be provided for items not listed
Prices are subject to tax for residents of TN
Prices are subject to change

Search Engine Result Page (SERP) Ranking

Currently known best practices will be implemented when your site is constructed to help make your site visible to your potential clients via search engine queries. Because the search engines change their algorithms frequently, no guarantee can be made concerning how well your website will rank in the result pages. Ongoing Search Engine Optimization (SEO) is a different service than web design and is not included in this agreement. Specifically, SEO may include:

Link building campaigns
Affiliate campaigns
Article writing and press release campaigns
Continuous monitoring of website ranking and keyword adjustment
Blogs or social networking initiatives

These services would result in additional and potentially third party charges.

Copyrights and Trademarks

We ask that you guarantee that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to us for inclusion in webpages or brochures are owned by you, or that you have permission from the rightful owner to use each of these elements, and will hold harmless, protect, and defend Cadre Marketing LLC and its subcontractors from any claim or suit arising from the use of such elements furnished by you.

Copyright to Webpages and Brochure Artwork. Copyright to the finished assembled work of webpages or brochures produced by Cadre Marketing, LLC is owned by Cadre Marketing LLC until final payment of development fees, at which time you will own the copyright. Rights to photos, work-up files, and computer programs are specifically not transferred to the client, and remain the property of their respective owners. Cadre Marketing, LLC and its subcontractors retain the right to display graphics and other Web design elements as examples of their work in their respective portfolios.
